PROTECTION OF PERSONAL DATA DURING THE FORMATION OF VOTER LISTS IS A REQUIREMENT OF THE TIME

In accordance with Article 27 of the Electoral Code of the Republic of Uzbekistan, during the election campaign, voter lists in each polling station are submitted by precinct election commissions for public review 15 days before the election.

This list includes the surname, name, patronymic of citizens, as well as their date of birth and address at the place of residence.

In accordance with this requirement, during elections held in the country, voter lists signed by the chairman and secretary of the precinct election commission, as well as certified by the seal of the precinct election commission, are posted on the stands in the building for public familiarization. Voters, in turn, visit the polling station before or on election day to obtain information about the accuracy of their data and the voting process at that polling station.

Some international observers who participated in the elections of the President of the Republic of Uzbekistan on October 24, 2021 expressed their opinions and recommendations on the provision of personal data of voters in the lists at polling stations, including their last names, first names and patronymics, dates of birth and addresses, which poses a threat to their security and can be used for criminal purposes.

Considering the above, the Central Election Commission has created a working group together with the Ministry of Justice, the State Center for Personalization and other relevant ministries and departments, which is working to improve the electoral legislation of the Republic of Uzbekistan and develop a draft law on the protection of personal data of citizens.

On January 24, the Central Election Commission held a regular meeting of the working group on improving the electoral legislation and the process of protecting personal data.

At the meeting, based on the electoral legislation of developed legal democratic states, it was proposed to supplement the norm with Article 28 of the Electoral Code of the Republic of Uzbekistan “The precinct election commission uses preliminary lists of voters to clarify it by conducting door-to-door rounds of the population. This list may not be photographed, filmed, or otherwise reproduced or distributed, including publicly posted for the information of others on the Internet and social networks. As well as Article 29 of the Electoral Code “The list will be posted on stands in the building of the precinct election commission in places convenient for familiarization. This list does not indicate the address of the place of residence of voters.

The participants of the event agreed to prepare additional proposals justified in accordance with the Law of the Republic of Uzbekistan "On Personal Data", the electoral legislation and practice of foreign countries, which will be considered in detail at the next meeting.

In the draft document, along with ensuring the security of personal data, specific solutions will be provided for existing problems in the formation of the list of voters.
